Terms of Service
1. Agreement to these Terms
Mental.OS ("Mental.OS," "the Service," "we," "us," or "our") is a self-guided personal-development platform. These Terms form a binding agreement between you and the operator of Mental.OS. By creating an account, checking the acceptance box during registration, starting or continuing a program while signed out, accessing the Service, or submitting content, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not create an account, start a program, or use the Service.
Electronic acceptance has the same effect as a written signature to the extent permitted by law. You are responsible for reviewing these Terms before using a program or feature.
2. Eligibility
You must be at least 18 years old and legally capable of entering into this agreement, or otherwise have reached the age of legal majority where you live. By using the Service, you represent that you meet these requirements. The Service is not directed to children. Do not use the Service for another person without their knowledge and lawful consent.
3. The Service is not health care
Mental.OS is not a medical provider, mental-health professional, therapist, counselor, crisis service, hospital, or health plan. The Service does not create a doctor-patient, therapist-client, fiduciary, or other professional relationship. Programs, lenses, diary prompts, actions, AI-assisted text, community content, scores, and recommendations are self-help, educational, entertainment, reflection, and personal-development tools only.
Nothing on the Service is a diagnosis, medical or psychological assessment, treatment plan, prescription, prognosis, safety plan, or substitute for qualified professional care. Do not start, stop, delay, or change medication, therapy, medical treatment, substance-use treatment, or other professional care because of the Service. Do not rely on the Service as the sole basis for decisions involving health, safety, finances, law, housing, employment, relationships, pregnancy, substance use, or other high-consequence matters.
The Service does not promise that a program is clinically appropriate, evidence-based, suitable for your circumstances, or capable of preventing, improving, or curing any symptom, disorder, condition, behavior, or outcome.
4. Emergencies, crisis situations, and no monitoring
Mental.OS is not an emergency or crisis-response service. Do not use a diary entry, custom program, Wall post, feedback form, profile, or any other feature to request emergency assistance. Private writing and user activity are not continuously monitored for danger, self-harm, abuse, medical emergencies, or criminal activity. We do not undertake a duty to identify a crisis, contact you, contact another person, dispatch emergency services, or intervene based on anything entered into or generated by the Service.
If you or another person may be in immediate danger, call local emergency services now. In the United States, call 911 for an immediate emergency or call or text 988 for the Suicide & Crisis Lifeline. Outside the United States, contact the emergency or crisis service available where you are. Do not wait for a response from Mental.OS.
5. Possible adverse effects and assumption of risk
Reflection and behavior-change material can be uncomfortable, upsetting, triggering, inaccurate, or unsuitable. Programs may cause or contribute to emotional distress, anxiety, rumination, shame, anger, fear, compulsive use, interpersonal conflict, sleep disruption, resurfacing memories, or other unwanted reactions. Symptoms or conditions may emerge, recur, intensify, be misunderstood, or go untreated if you rely on the Service instead of obtaining appropriate care. Results vary and some users may receive no benefit or may feel worse.
You voluntarily choose whether to use each program and assume the risks of self-guided use to the fullest extent permitted by law. Stop using a program if it increases distress, encourages unsafe behavior, conflicts with professional advice, or feels inappropriate. Seek qualified help when needed. You remain responsible for your choices, actions, communications, physical activity, and decisions made during or after use of the Service.
6. Physical actions and real-world decisions
Some programs may suggest movement, exercise, changing an environment, contacting another person, delaying an urge, spending or saving money, changing a routine, setting a boundary, or completing another real-world action. Consider your health, abilities, surroundings, legal obligations, finances, and personal safety before acting. Do not perform an action while driving, operating machinery, intoxicated, medically unstable, or in any situation where distraction or physical activity may be unsafe. You are responsible for modifying, skipping, or stopping any action that is not safe or appropriate for you.
7. Custom, community, and AI-generated programs
Programs and other content may be created or edited by users, administrators, automated systems, or third-party artificial-intelligence providers. Custom, community, imported, and AI-generated content may contain mistakes, fabricated information, harmful suggestions, bias, offensive material, outdated information, or instructions that do not fit your circumstances. Such content is not necessarily reviewed by a licensed professional.
Approval, publication, moderation, popularity, points, likes, saves, creator status, a featured placement, or availability through Mental.OS does not constitute professional review, certification, endorsement, or a guarantee of safety or accuracy. Moderation is limited and cannot detect or prevent every harmful program or outcome. You must independently evaluate content before following it.
Creators are responsible for the programs and submissions they publish. Users who choose to run them are responsible for deciding whether to proceed. AI assistance does not transfer responsibility for created, edited, imported, submitted, or followed content to Mental.OS or the AI provider.
8. Prohibited and improper use
You may not use the Service to:
- diagnose, treat, supervise, control, or provide emergency care to another person;
- encourage, instruct, glorify, or facilitate suicide, self-harm, violence, abuse, dangerous substance use, starvation, purging, or other serious harm;
- coerce, manipulate, threaten, stalk, harass, shame, discriminate against, or exploit another person;
- create a program that impersonates a licensed professional or falsely claims clinical approval, guaranteed results, or medical effectiveness;
- submit illegal content, malware, spam, doxxing, credible threats, non-consensual intimate imagery, sexual content involving minors, or content that infringes another person's rights;
- bypass safeguards, moderation, rate limits, access controls, score validation, account restrictions, or security systems;
- misrepresent scores, progress, credentials, identity, age, authorship, endorsements, or affiliations;
- use the Service in a way that creates unreasonable risk to yourself, another person, property, or the Service.
You are responsible for misuse performed through your account and for any program or instruction you create, import, publish, send, or direct another person to use.
9. Accounts and information we store
When you create an account, we may store your username, password hash, optional email address, optional display name and bio, profile settings, and dates associated with account creation and acceptance of these Terms. You are responsible for protecting your credentials and for activity performed through your account.
We may also store programs and content you create, private diary entries, tasks, action responses, saves, reactions, follows, friendships, Wall posts, votes, social activity, progress, rewards, purchases, Arena results, and related usage or security information. Public and private information are handled as described in the Privacy Policy and available settings.
Private diary entries, tasks, and action responses are not routinely monitored and are not displayed publicly. Authorized administrative access may occur for operational, support, security, legal, safety, export, enforcement, or business-transaction reasons described in the Privacy Policy. Authorized administrators may deliberately export diary content through administrative tools. Administrative access does not turn the Service into an emergency-monitoring or professional-care service.
10. Email and data practices
Email is optional. If you provide one, we may use it for account, support, security, policy, Service, and other communications permitted by law. Providing an email does not by itself authorize an undisclosed sale of your information.
As of the effective date of the Privacy Policy, we do not sell or share personal information as those terms are defined by applicable privacy law. Our practices may change as the Service develops. Before beginning a materially different sale or sharing practice, we will update our disclosures and provide any notice, consent mechanism, opt-out method, or other choice required by applicable law. Information may also be disclosed to service providers, for legal or safety reasons, or in connection with a merger, acquisition, financing, reorganization, bankruptcy, asset sale, or similar transaction as described in the Privacy Policy.
11. User-submitted content and licenses
The Service allows public content, including programs, lens proposals, profile information, Wall posts, and other shared material ("Public Submissions"), and private content, including diary entries, private tasks, and private action responses ("Private Content"). You retain ownership of your submissions, subject to the licenses below.
- Public Submissions. You grant us a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, display, reformat, moderate, adapt, distribute, and promote Public Submissions in connection with operating, improving, and promoting the Service.
- Private Content. You grant us the limited license reasonably necessary to host, secure, back up, process, export, display back to you, and otherwise operate the Service as described in the Privacy Policy. Storing private diary text does not grant a general promotional license to publish it.
- Your responsibility. You must have the rights needed to submit content and are responsible for its accuracy, legality, and effect.
- Moderation. We may restrict, reject, remove, preserve, edit, label, or disclose content and may suspend or terminate accounts when reasonably necessary to operate or protect the Service, enforce these Terms, comply with law, or address safety, abuse, or infringement concerns. We are not required to pre-screen or continuously monitor all content.
- Copyright notices. If you believe public content on the Service infringes your copyright, use the contact method in the footer and provide identification of the work, the location of the material, your contact information, a good-faith statement, and a statement under penalty of perjury that the notice is accurate and you are authorized to act.
12. References to third-party works
Some lenses and programs reference titles, characters, settings, themes, scenes, mechanics, music, books, public figures, or other works for commentary, comparison, transformative metaphor, and education. We do not claim ownership, affiliation, sponsorship, or endorsement by rights holders. Fair use and similar doctrines are fact-specific, and no statement in these Terms guarantees that every user submission qualifies.
13. Third-party services and links
The Service may use or link to hosting companies, AI providers, analytics, payment services, email providers, external resources, or other third-party services. We do not control and are not responsible for third-party content, availability, security, privacy practices, advice, or actions. Your use of a third party may be governed by separate terms and policies.
14. Points, scores, rewards, and virtual features
Voting limits, review standards, points, virtual currency, unlocks, ranks, rewards, approval status, and eligibility rules may change. They do not create an ownership interest, medical result, financial account, employment relationship, or contractual right to publication or continued availability. Unless required by law or expressly stated otherwise, virtual items and points have no cash value and are not transferable outside the Service.
15. Account suspension, deletion, and Service changes
You may request or use available tools to delete your account. Deletion may remove or de-identify account information, private content, connections, and personal activity while allowing public programs or other Public Submissions to remain under the license above, with author information removed or reassigned where appropriate. We may retain limited records for security, fraud prevention, legal compliance, disputes, or enforcement.
We may add, modify, rebalance, restrict, suspend, or discontinue accounts, features, programs, rewards, points, virtual currency, rankings, or the Service at any time, subject to applicable law. We may suspend or terminate access to enforce these Terms, protect users or the Service, address abuse or security threats, comply with law, or discontinue operations.
16. No warranties
To the maximum extent permitted by law, the Service and all content are provided "as is" and "as available," with all faults and without warranties of any kind, express, implied, statutory, or otherwise. This includes warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, safety, clinical suitability, effectiveness, availability, security, uninterrupted operation, error-free operation, or any particular emotional, behavioral, medical, social, financial, or other result. We do not warrant that moderation will identify every harmful item or that data will never be lost, exposed, altered, or unavailable.
17. Limitation of liability and release
To the maximum extent permitted by law, Mental.OS and its operator, affiliates, employees, contractors, licensors, service providers, and agents will not be liable for any direct or indirect injury, loss, or damage arising out of or related to the Service, content, a program, a user's conduct, an omitted warning, moderation, reliance, inability to access the Service, or any action taken or not taken after using the Service.
This limitation includes, without limitation, emotional or psychological distress; emergence, recurrence, worsening, misidentification, or delayed diagnosis or treatment of symptoms, disorders, or conditions; compulsive or improper use; medication or treatment decisions; substance use; relationship, employment, housing, legal, or financial consequences; loss of data, income, opportunity, goodwill, or reputation; physical injury, illness, disability, hospitalization, self-harm, suicide, death, property damage, or harm caused by a custom, community, imported, administrator-created, or AI-generated program.
To the maximum extent permitted by law, we are not liable for incidental, consequential, special, exemplary, punitive, or multiplied damages, even if advised that such damages are possible. To the maximum extent permitted by law, our total aggregate liability for all claims arising from the Service or these Terms will not exceed the greater of the amount you paid directly to us for the Service during the twelve months before the event giving rise to the claim or one hundred U.S. dollars ($100).
To the fullest extent permitted by law, you release the parties listed above from claims arising from risks you knowingly assume under these Terms or from the conduct, content, or programs of other users and third parties.
18. Indemnification
To the extent permitted by law, you agree to indemnify, defend, and hold harmless Mental.OS and its operator, affiliates, employees, contractors, service providers, and agents from claims, demands, investigations, losses, liabilities, damages, judgments, settlements, and reasonable legal costs arising from your misuse of the Service; your custom programs or submissions; your instructions to another person; your violation of these Terms or law; or your violation of another person's rights.
19. Rights that cannot be waived
Some jurisdictions do not allow certain warranty exclusions, releases, damages limitations, indemnities, or liability caps. Those provisions apply only to the extent legally permitted. Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, gross negligence, or any other liability that applicable law does not permit us to exclude or limit. Nothing waives nonwaivable consumer rights.
20. Governing law and disputes
These Terms are governed by the laws applicable in the operator's principal jurisdiction, without regard to conflict-of-law principles, except where consumer-protection law requires otherwise. Any required venue or dispute process remains subject to applicable law.
21. Changes to these Terms
We may update these Terms as the Service changes. The effective date and version above will be revised. We will provide additional notice or obtain consent when required for a material change. Continued use after the effective date of an updated version constitutes acceptance to the extent permitted by law, but does not eliminate rights that cannot legally be waived or automatically authorize retroactive material changes where additional notice, consent, or choice is required.
22. Severability, no waiver, and entire agreement
If a provision is found unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. These Terms and the Privacy Policy are the entire agreement concerning your use of the Service unless another written agreement expressly applies.
